Hipaa Compliance

I briefly read the Hippa rules and regulaions this morning. One of the last portions I read dealt with the types of insurance filed that thus required Hippa compliance by the practioner. I do not file insurance. Does this mean the data I have on my server is exempt from Hippa compliance rules.

HIPAA as it relates to the dentist, is all about insurance. Specifically electronically submitted insurance. If one is all cash, and one doesn't bill insurance electronically (even as a courtesy for one's patients)one does not need to comply with HIPAA..........or so I have been told numerous times by lectures regarding the topic as well as by the ADA.

It still happens.....
where it says Contents not allowed in brackets, substitute that for dot ada dot content backslash

WTF...... contents not allowed = ada
WTF.... contents not allowed = the three letter abreviation for the american dental association

Insurance is filed by the billing Dr office. I am an independant contractor and just provide the service. The Dr Pays me directly the day of service. Unless the service is just sedation and then the patient pays me and I provide them a statement and the patient pays me directly the day of service. I do not file any insurance but I know that insurance is being filed by someone else. I am listed as the treating provider.

Is your name on the claim? you stated "yes"

Is your tax id on the claim?

Is the claim filed electronically?

I think my NPI and License number are on the claim. I honestly have never looked. I doubt my tax id is there as each office sends me a 1099 each year and I do not get any from the insurance companies. I do not know how each office files the claim.

If your name is listed on Line 53 of the ADA Claim Form, you are considered the provider.
If the information of the provided care is sent electronically, then you are considered to be a "covered entity."

The easiest test I can come up with would be to "inquire about benefits" for one of your patients ins co. that is known to have had a claim filed listing you as a provider.
If the insurance company confirms treatment by you, well your question is answered.
If the insurance company states that the treatment was done by your contract office, then you may be clear.
